Booking Terms and Conditions including COVID 19

Your contract is with Susan Bell, Neville Thomas and Sian Thomas, for the property known as Mina, Emir Apartments,
Milli Egemenlik Cd, Kalkan, Turkey. Reference to ‘you’ or ‘your’ are references to the person making the booking and all members of the holiday party.
These Booking Terms and Conditions form the basis of your contract with us so please read them carefully. Nothing in these Booking Conditions affects your normal statutory rights.

Making your booking

Reservations

Provisional reservations may be made free of charge and the Mina apartment reserved in your name for a period of 5 days to enable you to book flights and make other travel arrangements.
We will send you by email or, if preferred, text message, a confirmation that the apartment has been reserved in your name and confirmation of the booking details, including date and time of arrival and departure and rental cost.
We ask you to confirm by email, text message or telephone that you wish to proceed with your booking by 12 noon on the fifth day after you make your provisional reservation.
We will then send you confirmation of your booking along with the Booking Form, which we request that you complete and return to us together with a non-refundable deposit, as below.
If you do not confirm that you wish to proceed within the specified time we reserve the right to offer the apartment to other interested parties.

Deposit

A £250 non-refundable deposit will secure your booking.
On receipt of the Booking Form and Deposit we will send you our written confirmation of your booking.

Payment of balance

The balance is to be paid 8 weeks prior to departure.
Payment may be made by cheque, bank transfer or PayPal.
If payment is not received we reserve the right to re-offer the dates to other interested parties.

Late Bookings

For bookings made less than 8 weeks prior to departure the full payment is required at time of booking.

Cancellation and COVID

In the event that the British or Turkish governments impose Covid-19 restrictions which affect your flights or any member of your party tests positive for Covid-19 and makes it impossible for you to travel to Turkey, we will refund the full amount you have paid to us.
If, for any other reason, you cancel the booking No refunds will be paid.
You are advised to obtain full holiday insurance to cover your costs should your circumstances change.
In the unlikely event that the Mina apartment cannot be made available to you through circumstances beyond our control (ie earthquake, fire or other catastrophic event) we will notify you immediately and offer a full refund in respect of the payment received for the apartment and deposit.

Damage Deposit

A damage deposit of £250 will be required, payable eight weeks prior to your arrival date, to cover any breakages or damage caused. This will be returned in full within 2 weeks of your return, provided no damage or breakages have been incurred.
We accept that it is inevitable that from time to time accidents will happen and any breakages will be replaced at cost price and the balance returned to you. Please advise our on site manager of any breakages or damage prior to departure in order that these items may be replaced prior to the next guests arriving.
Your liability is not limited to the above sum. You are liable for the full sum of any damage caused by your actions or negligence.
Replacement keys or keys not returned to reception at time of departure will be charged at £25 per key.

Flights, Transfers & Car Hire

The cost of flights is not included in the price of the Mina apartment. You must make your own flight reservations and travel arrangements.
In order to encourage tourism, Turkey has removed from 2 March 2020, the requirement for visitors from the UK to obtain an entry Visa. For up to date Visa information please check the The Turkish Ministry website www.evisa.gov.tr/en
Visitors are permitted to stay in Turkey for a maximum of 90 days out of 180 from the date of arrival, multiple visits are permitted within the 180 day period. You must have a valid passport with a minimum of six months, unexpired on the date of your arrival in Turkey.
The cost of transfers from the airport to Kalkan is not included in the price. We can arrange for a driver from a reliable Kalkan based taxi company to meet your party at the airport and deliver you to the Mina apartment and return you to the airport on the day of departure, in either a private air-conditioned car or mini bus. You are responsible for payment in Kalkan, direct to the taxi company in pounds sterling, Turkish Lira, Euros, US Dollars or by major credit card.

Cleaning and Linen Change

Fresh bed linen and towels will be provided twice a week (on the day of your arrival, and midway through the week). There is a daily on site maid service and the apartment will be cleaned twice a week.
Suitability
The Mina apartment is ideal for couples, friends, families and children. Children must, however, be supervised at all times around the pool areas and on the apartment’s balconies. The apartment is not suitable for very small children as there are no stair gates.
No pets or animals of any kind are permitted in the apartment and the damage deposit may be forfeited.
Strictly No Smoking is permitted within apartment. The damage deposit will be forfeited if reports of smoking within the apartment are received from our local representatives.
Not suitable for guests with walking difficulties or the infirm.

 

What is included

Mina is a self-catering apartment, equipped and furnished for your holiday needs.
The price includes the services of the Emir staff, together with the cost of air-conditioning, electricity and gas.
Guests have free use of the two Emir private swimming pools, sun beds and sunshades.
To assist guests with their baggage allowance, pool towels are provided for the exclusive use of our guests.
A small welcome pack of essentials including bread, jam, water, milk and one beer or a soft drink per person will be provided on your arrival. The local shops stay open until late and are only a few minutes walk from the apartment. If you are arriving late in the evening or early morning and require additional provisions to be purchased for you prior to your arrival, including for example, wine and beer, coffee and tea etc please let us know and this can be arranged for an additional cost.
There is a daily maid service for the emptying of bins and the apartment will be fully cleaned on the day of arrival and midway through the week.
The apartment is equipped for your holiday as described on our website www.mina-kalkan.co.uk under the heading accommodation.
Guests have free access to the Emir wi-fi connection but must provide their own receiving equipment ie phone, tablet or computer.
Please note that there is no TV or DVD player

Arrival and departure times

The apartment will be available for you from 2pm on the day of your arrival. Please let us know your fight details and anticipated arrival times. The keys will be handed to you by the resident English speaking manager who will show you the apartment.
Guests are required to check out of the apartment by mid-day on the date of departure.
Luggage may be left in the reception area and there are toilets and shower facilities available by the pool should you wish to swim in the afternoon.

Manager

The English speaking manager of the Emir apartments and her husband, together with their on site team, are pleased to welcome our guests and assist you in any way they can, in order to make your stay in Mina and Kalkan an enjoyable one.
You agree to allow us or any representatives of ours access at any reasonable time during your stay for the purpose of essential repairs and cleaning of the apartment.

Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday, if however, you have cause for complaint it is important that remedial action is taken as soon as possible. It is essential that you contact us if any problems arise so that it can be speedily resolved. Our onsite manager will normally be able to rectify any shortcomings with regard to the preparation of the apartment or any repairs that may be necessary, but only if we are notified.
If any complaint cannot be resolved during your holiday, you must write to us with full details within 28 days of your departure.

Our Liability

Our maximum liability for losses you suffer as a result of us acting in breach of these Terms and Conditions is strictly limited to the amount you have paid to us. In the unlikely event that the Mina apartment cannot be made available to you through circumstances beyond our control (ie earthquake, fire or other catastrophic event) we will notify you immediately and offer a full refund in respect of the payment received for the apartment and deposit.
No liability to you is accepted in respect of damage to or loss of personal property except where the damage or loss is caused by our negligence.
You travel to and use the Mina apartment at the Emir Kalkan entirely at your own risk, fully aware of the risks associated with Covid-19. No liability to you is accepted in respect of any consequences of Covid-19.

Your obligations

You agree to comply with the directions set out in the Mina House book located in the apartment and any directions issued by our on site manager for the safety and enjoyment of our staff and other guests and ensure that they are observed by all members of your party.
You agree to keep and leave the apartment and the furnishings, kitchen equipment, crockery, glasses, bedding and towels, clean and in a good condition.
You agree not to cause any damage to the walls, doors or windows of the apartment or any of the common facilities nor to do anything that may be reasonably considered a nuisance or annoyance to us or any other occupier of adjoining or neighbouring properties.
You agree to take all necessary steps to safeguard your personal property. No liability to you is accepted in respect of damage to or loss of such property except where the damage or loss is caused by our negligence.
You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property and health insurance including evacuation and repatriation coverage).
You agree not to allow more than six people to stay in the apartment, nor can you significantly change the makeup of the party during your stay. If you do so we may refuse you access to the apartment or require you to leave it.
You agree not to allow any person not staying at the Emir to use the swimming pools and common areas.
You agree not to bring, encourage or feed any animals in the Emir grounds or the Mina apartment.
You agree to permit the passport details of each member of your party to be photocopied and submitted to the Jandarma to comply with Law No 1774 Declaration of Identities and Statutory Decree No 678

Law

Your booking is made as a consumer for the purposes of a holiday and you acknowledge that no liability can be accepted for any business losses, however suffered or incurred by you.
The contract between you and us is governed by the law of England and Wales and we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of England and Wales.
No part of this document constitutes an offer or creates a contract until such time as we confirm your booking in writing and the full rental payment has been received.
